San Antonio police officials Tuesday identified the driver as Hector Lopez, 31, who was taken into custody shortly after the fatal crash and was booked at the Central Magistrate's Office early Tuesday morning.

Allen was on his Harley-Davidson turning onto North Weidner Road from Wurzbach Parkway around 7 p.m. Monday when Lopez ran a red light at the intersection and drove his BMW SUV into Allen, who was wearing a helmet at the time of the crash, according to preliminary information released by SAPD.

Lopez was evaluated at the scene and officers determined that he was intoxicated at the time of the fatal crash.

Lopez is now facing second- and third-degree felonies. His bail was set at $85,000.

According to online records, Lopez was arrested in September 2008 for DWI but his case was dismissed due to a missing witness.
