Repeat DWI suspect remanded without bail

Stephanie Cerda accused of tampering with her ankle monitor

Calling her "scary," a district court judge remanded DWI suspect Stephanie Cerda without bail Monday afternoon.

Cerda, who was arrested for driving while intoxicated three times between April 2010 and May 2011, was arrested again last Thursday, after a sensor in her ankle monitoring bracelet detected tampering, which generated an arrest warrant.

In April 2010, police said Cerda was intoxicated and drove the wrong way on I-35, slamming into Gerardo Razo's car, leaving him with with serious injuries.

Razo filed and won a civil lawsuit against Cerda, and was awarded $2.7 million in damages.

Cerda's attorney, Fernando Trevino, argued in court that his client's monitoring device malfunctioned, and that Cerda never removed the anklet.

Police believe Cerda slipped out of her ankle monitor before her most recent DWI arrest. Trevino, who admitted his client has had a troubled history, said that was not the case this time.

"They even testified that we don't have someone to go out there and personally look at the devices if there's tampering or anything.  If there's anything wrong with the devices, they issue a warrant.  I mean, that's in violation of due process," Trevino said.

A date has not yet been set for Cerda's next court hearing.
