Man, 75, found not guilty in shooting death over parking dispute

Franklin Martinez on trial for 2015 fatal shooting of Manuel Lopez

SAN ANTONIO – A Bexar County jury on Thursday found a 75-year-old man not guilty of murder.

Franklin Martinez was on trial for the November 2015 fatal shooting of Manuel Lopez.

According to trial testimony, Martinez fatally shot Lopez in a dispute over parking on Elvira Street.

"You need to tell your buddies not to park in front of the house," Martinez said to the victim, according to an arrest affidavit. 

"You don’t own the street," Lopez told Martinez, the affidavit said. 

Lopez threw a can at Martinez’s truck and Martinez then pulled out a small handgun, shooting Lopez in the chest, the affidavit said.

The victim died a few days later.

Martinez testified that he shot Lopez because he feared for his life.
