Chief McManus: Bond hearing for Cody Gann on Monday

SAN ANTONIO – Charged with the murder of a 10-year-old, Cody Gann, 18, never even saw the inside of the Bexar County Jail for the crime before he was released on bond.

San Antonio Police Chief William McManus wants to change that.

"You've got an individual who's charged with shooting a 10-year-old — killing a 10-year-old. Two years younger and it would have been a capital murder. And less than — from 10 o'clock the night before 'til 1 o'clock or so the next day — and he's getting out of jail? People would be very, very angry to know that," McManus said.

Gann is accused of killing Delilah Hernandez in a Thanksgiving morning drive-by shooting. He was released Friday afternoon from the Bexar County Central Magistrate's Office on a $250,000 bond, which McManus is hoping will be raised at a bond hearing Monday.

Having spoken to reporters around 10 p.m. Thursday as his officers brought in Gann, McManus was angry to see him ready to be released the next day when he went to the magistrate's office.

McManus said he called the district attorney, who he said will have a bond hearing Monday. The chief hopes that will mean a raised bond and Gann heading to jail.

This isn't the first time Gann has gotten out. A search of court records shows he was already out on bonds totaling $99,000 for six different charges, including aggravated robbery and unauthorized use of a vehicle. 

All of those offenses were reported to have happened within the past nine months.
