Man was driving drunk when he crashed, killing his nephew, police say

Jose Gonzalez-Montiel, 31, charged with intoxication manslaughter

SAN ANTONIO – San Antonio police say they have determined that a man was driving drunk when he crashed his car, killing his nephew.

A charge of intoxication manslaughter was filed this week against Jose Gonzalez-Montiel, 31, in connection with the May 28 crash, which happened in the 10900 block of Applewhite Road. He was booked into jail Sunday.

Gonzalez's 23-year-old nephew, Armando Palafox-Gonzalez, was killed in the rollover crash. Both men were ejected from the vehicle.

An arrest warrant affidavit said Gonzalez was found with his legs pinned beneath the wreckage, and paramedics who freed him told police they smelled alcohol on his breath.

Palafox-Gonzalez suffered head and internal injuries. He died about three weeks after the crash.

The affidavit said another relative told police during a memorial service for the nephew, Gonzalez apologized for causing his death.

Police said he admitted to them that he had consumed 6-8 beers at a racetrack in the hours before the crash.

They said tests also confirmed that Gonzalez, who was driving the car, was drunk.
