A federal grand jury in Austin returned a seven-count indictment Tuesday charging Paul Kruse with six counts of wire fraud and one count of conspiracy to commit wire fraud, according to a Justice Department statement. Health officials notified Blue Bell in February 2015 that two ice cream products from the company’s flagship factory in the central Texas city of Brenham and its Broken Arrow, Oklahoma, plant tested positive for listeria. Blue Bell recalled products after its ice cream was linked to 10 listeria cases in four states, including three deaths in Kansas. Prosecutors allege that Kruse schemed to deceive Blue Bell customers by directing employees to remove potentially contaminated products from store freezers without alerting grocers and consumers as to why. Kruse was initially charged May 1, the same day that Blue Bell Creameries pleaded guilty to two counts of distributing contaminated goods.

Blue Bell Creameries L.P. was ordered by a federal court to pay $17.25 million in criminal penalties for sending out contaminated products linked to a 2015 listeria outbreak, the U.S. Department of Justice announced Thursday. The DOJ said Blue Bell pleaded guilty to two misdemeanor counts of distributing adulterated ice cream products in May 2020. The FDA, CDC and Blue Bell issued public recalls on March 13, 2015. A second recall was announced 10 days later after tests confirmed listeria contamination at a Blue Bell facility in Broken Arrow, Oklahoma. Blue Bell temporarily closed down all of its facilities in late April 2015 to clean and update equipment.

H-E-B officials confirmed Tuesday that video of a girl opening a gallon of Blue Bell ice cream, licking the ice cream and then placing it back into a grocery store fridge was not filmed inside an H-E-B store. And despite Facebook detectives claiming otherwise, San Antonio police said they have not received information as to whether the woman in the video lives in San Antonio.
